Terms of Service
The operating entity and jurisdiction have not been filled in yet. Complete them in Admin → Settings before relying on these terms, and have a qualified lawyer review them for your jurisdiction.
These Terms of Service ("Terms") govern your use of sms.rip (the "Service"), operated by [legal entity name] ("we", "us"). By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.
1. What the Service does
We provide temporary access to virtual telephone numbers so that you can receive a one-time SMS verification code from a third-party website or application. Access to each number is granted for a single verification and for a limited time.
We are a reseller of telecommunications capacity. We do not operate the mobile networks that deliver messages and we do not control whether any third party chooses to send an SMS to a given number, or accepts a number of a given type or country.
2. Eligibility
The service exists to keep your own phone number private when a website or app asks you to verify one. There is no age restriction on using it: not handing your real number to a stranger is a safety measure, and it is one younger users benefit from at least as much as anyone else.
- You must have the legal capacity to enter into a binding contract. If you are under the age of majority where you live, you may use the service with the involvement of a parent or guardian, who accepts these terms on your behalf.
- You must not be located in, or ordinarily resident in, a country subject to comprehensive sanctions, and must not be a person with whom we are prohibited from dealing under applicable sanctions laws.
Whatever your age, never use a temporary number for banking, account recovery, or anything you would need to get back into later. These numbers are shared and reissued, and once one leaves your hands anyone who holds it next can receive its messages.
3. Accounts
You are responsible for all activity under your account, including activity by anyone you allow to use it and any use of your API key. Keep your credentials confidential and tell us promptly if you believe they have been compromised.
You may hold one account unless we agree otherwise in writing. We may suspend or close accounts we reasonably believe are duplicates created to abuse promotions, referral commission, or usage limits.
4. Acceptable use
Your use of the Service is subject to our Acceptable Use Policy, which forms part of these Terms. In summary, you must not use the Service to commit fraud, to impersonate another person, to evade a lawful ban, to send or solicit unlawful content, or in breach of the terms of any third-party platform you verify against.
You are responsible for how you use a number. Many platforms prohibit registration using virtual numbers. Whether your use complies with a third party's rules is a matter between you and that third party. We do not advise on, endorse, or take responsibility for your use of any platform.
5. Balance, pricing and payment
- The Service operates on a prepaid balance. You add funds, then spend them on numbers.
- Deposits are made in cryptocurrency through our payment processor. The minimum deposit is $5.00.
- Prices are shown in US dollars before you commit to a purchase, and are the prices that apply to that purchase.
- Prices change with supply and demand. A price you saw previously does not bind us for a later purchase.
- Your balance is a prepaid credit for use on the Service. It is not a deposit, is not held on trust, earns no interest, and is not a claim on any bank account.
6. Refunds
Refunds are governed by our Refund Policy.
The short version. If no SMS arrives within 20 minutes, your purchase is refunded to your balance automatically and in full. If you cancel before then, you are refunded immediately. Once a verification code has been delivered to you, the purchase has been fulfilled and is not refundable — including where the third-party platform subsequently rejects, bans or deletes your account.
7. Availability
We aim to keep the Service available but do not guarantee uninterrupted operation. Numbers for a particular service or country may be unavailable at any time. We may perform maintenance, change or withdraw features, and impose reasonable rate limits.
Delivery of SMS depends on mobile networks and on the sending platform. We do not guarantee that any particular message will arrive, which is precisely why the automatic refund in clause 6 exists.
8. Suspension and termination
We may suspend or terminate your access, withhold provision of further numbers, and where lawful withhold or reverse balance, if we reasonably believe you have:
- breached these Terms or the Acceptable Use Policy;
- used the Service for fraud or other unlawful activity;
- abused the referral programme, chargebacks, or the refund mechanism; or
- created risk of legal liability for us or our suppliers.
You may close your account at any time by contacting us. Unspent balance is dealt with under the Refund Policy.
9. Intellectual property
The Service, its software, and its content are owned by us or our licensors. Third-party names and logos shown on the Service are the trademarks of their respective owners and are used only to identify the platform a number may be used to verify against. Their appearance does not imply any affiliation with, sponsorship by, or endorsement from those owners.
10. Disclaimers
To the maximum extent permitted by law, the Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, or for fraud. If you deal as a consumer, your statutory rights are unaffected.
11. Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive loss, or for loss of profit, revenue, data, goodwill, or for the loss, suspension or termination of any third-party account.
Our total aggregate liability arising out of or in connection with the Service is limited to the greater of (a) the total amount you paid us in the three months before the event giving rise to the claim, or (b) $50.
12. Indemnity
You agree to indemnify us against claims, losses and reasonable costs arising from your breach of these Terms or the Acceptable Use Policy, or from your unlawful use of the Service.
13. Changes to these Terms
We may update these Terms. Where a change materially reduces your rights we will give reasonable notice, for example by email or a notice in your account. Continued use after a change takes effect constitutes acceptance. The current version is always published here with its effective date.
14. Governing law
These Terms are governed by the laws of [jurisdiction], and the courts of [jurisdiction] have exclusive jurisdiction, except that if you are a consumer you may also bring proceedings in the courts of your country of residence and benefit from mandatory consumer protections there.
